END-USER LICENSE AGREEMENT FOR GRAPEBACKUP BASIC This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Tim Lebedkov. If you do not agree to the terms of this EULA, do not install, copy, or use GrapeBackup Basic.
SOFTWARE PRODUCT LICENSE GrapeBackup Basic is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. GrapeBackup Basic is licensed, not sold.
LICENSE/USAGE TERMS The licensee is granted to install and use GrapeBackup Basic on unlimited number of computers to be used by unlimited number of users also for commercial purposes.
DISCLAIMER OF WARRANTY GRAPEBACKUP BASIC AND THE ACCOMPANYING FILES ARE SOLD "AS IS". Tim Lebedkov MAKES AND CUSTOMER RECEIVES FROM Tim Lebedkov NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND WITH RESPECT TO THE SOFTWARE PRODUCT, DOCUMENTATION, MAINTENANCE SERVICES, THIRD PARTY SOFTWARE OR OTHER SERVICES. Tim Lebedkov SPECIFICALLY DISCLAIMS AND EXCLUDES ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. DUE TO THE VARIETY OF USER EXPERTISE, HARDWARE AND SOFTWARE ENVIRONMENTS INTO WHICH GrapeBackup Basic MAY BE SUBJECTED, THERE IS NO WARRANTY FOR TECHNICALLY ACCURATE PERFORMANCE. THE USER ASSUMES ALL RISK OF USING GrapeBackup Basic.
LIMITATION OF LIABILITY NO LIABILITY FOR CONSEQUENTIAL DAMAGES. To the maximum extent permitted by applicable law, in no event shall Tim Lebedkov or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profit, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of, or inability to use, this software product, even if Tim Lebedkov has been advised of the possibility of such damages.
